NOTICE OF TRUSTEE'S SALE WHEREAS, default has occurred in the performance of the covenants, terms and conditions of a Promissory Note, dated February 3, 2012, and the Deed of Trust of even date, securing said Promissory Note, recorded in Book 1419, page 712, et seq., in the Register's Office of Roane County, Tennessee, executed by Jennifer L. Jordan and husband, John Jordan, conveying certain property described therein to J. Arnold Fitzgerald, as Trustee for the benefit of Robert M. Witty, Trustee and Ann C. Witty, Trustee of the Robert and Ann Witty Revocable Living Trust. WHEREAS, the owner and holder of the Promissory Note has declared the entire indebtedness due and payable and demanded that the hereinafter described real property be advertised and sold in satisfaction of indebtedness and costs of foreclosure in accordance with the terms and provisions of the Promissory Note and Deed of Trust. NOW, THEREFORE, notice is hereby given that J. Arnold Fitzgerald, as Trustee, pursuant to the power, duty and authority vested in and conferred upon said Trustee, by the Deed of Trust, will on Friday, October 10, 2014, at 11:00 a.m. E.D.S.T. at the front door of the Roane County Courthouse in Kingston, Tennessee, offer for sale to the highest bidder for cash, and free from all legal, equitable and statutory rights of redemption, exemptions of homestead, rights by virtue of marriage, and all other exemptions of every kind, all of which have been waived in the Deed of Trust, certain real property located in Roane County, Tennessee, described as follows: Map 44M-A-37.00 BEGINNING on a stone and pointers, a corner of the old Highway tract, said stone BEING Lot No. 12, College Grove Estates, Unit 1, as shown by map of same of record in Map Book 6, page 86 (Slide 58), Register's Office, Roane County, Tennessee, to which map specific reference is hereby made for a more particular description of said lot. SUBJECT to all restrictions, easements, encumbrances and covenants of record. SUBJECT to any governmental zoning and subdivision ordinances and regulations in effect thereon. SUBJECT to any and all easements and rights-of-way, whether visible or not. FOR PRIOR TITLE see Book 1293, page 484 and Book 1419, page 710, Register's Office, Roane County, Tennessee. Said sale shall be held subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; to any matter that an accurate survey of the premises might disclose. To the best of the Trustee's knowledge, information and belief, there are no other federal or state tax lien claimants or other claimants upon the subject property which would require notice pursuant to the terms and provisions of T.C.A. 35-5-104 or T.C.A. 67-1-1433 or 26 U.S.C. 7425 or 28 U.S.C. 2410. The Trustee may postpone the above referenced sale from time to time as needed without further publication. The Trustee will announce the postponement on the date and at the time and location of the originally scheduled sale.
