  • NOTICE OF SUCCESSOR TRUSTEE'S SALE OF REAL ESTATE WHEREAS, on the 15th day of March, 2001, Dennis G. Caspelich and wife, Kimberly K. Caspelich, did make, execute, acknowledge and deliver a certain DEED OF TRUST to Sharon L. Reynolds, Trustee, to secure payment of a certain Promissory Note of even date therewith in the principal sum of Eight Thousand Dollars ($8,000.00), said note being payable to C. Tony Clough in installments as set forth in the Promissory Note, which Deed of Trust is of record in Trust Deed Book 723, at Page 595 et seq. in the Office of Register's Office for Roane County, Tennessee, which instrument is incorporated by reference for all purposes material to this instrument; and WHEREAS, Dennis G. Caspelich passed away intestate in Roane County, Tennessee, on January 5, 2005; and WHEREAS, C. Tony Clough, a/k/a Charles Anthony Clough, passed away intestate in Roane County, Tennessee, on October 28, 2014 and Lesi C. Gibson was appointed Personal Representative in the Probate Court for Roane County, Tennessee, in case number 2014-PR-5442; and WHEREAS, the Personal Representative appointed the undersigned Successor Trustee on April 28, 2017, by an instrument styled APPOINTMENT OF SUCCESSOR TRUSTEE and recorded in Book 1609, at Page 795, in the Office of the Register for Roane County, Tennessee, on May 5, 2017; and WHEREAS, default has been made in the payment of said indebtedness, now past due, and the entire amount of the same being declared due and payable in accordance with the terms of said note and DEED OF TRUST and Lesi P. Gibson, the owner and holder of said note and DEED OF TRUST, has directed me, the undersigned Successor Trustee, to foreclose said DEED OF TRUST in accordance with the terms thereof and to sell said real estate.
