NOTICE OF FORECLOSURE By virtue of the authority vested in me as Substitute Trustee, as contained in Deed of Trust from Dena R. Perkins and husband, David A. Perkins, to Sharon Sizemore, Trustee, dated October 24, 2006, of record in Book 1199, Page 881, Register's Office for Roane County, Tennessee, for which Wm. Stanton Massa, III has been appointed as Substitute Trustee, to which Deed of Trust reference is here made, Notice is hereby given that the property described below will be sold by me at the front door of the Roane County Courthouse, Kingston, Tennessee, at public auction, to the highest bidder for cash on March 6, 2015 at 11:00 a.m. to effect satisfaction of principal, interest, attorney's fees, costs, expenses and other lawful charges due on a promissory note dated October 24, 2006, from Dena R. Perkins and David A. Perkins to Regency Finance Company, and secured by the aforementioned Deed of Trust. LEGAL DESCRIPTION: SITUATE in Situated, lying and being in the Fifth (5th) Civil District of Roane County, Tennessee, now within the corporate limits of the City of Rockwood, and being known and designated as all of Lot Number Five (5) in Block Number Two (2) of the Clymersville Addition to the City of Rockwood and being designated also as House Number Eleven (11) in the Clymersville Addition to the City of Rockwood. Subject to an easement to Horsehead Resource Development Company herein by Deed recorded 7/31/99 in Deed Book J20 at Page 215. TAX ID# 054F-A-054K-018 This being the same property conveyed to David A. Perkins and Dena R. Perkins from Bobby G. Walker herein by Deed dated 4/27/77 and recorded 4/29/77 in Deed Book Z13 at Page 164. David A. Perkins died June 21, 2013, having remained continuously married to Dena R. Perkins until his death. Dena R. Perkins acquired sole title to the property as the surviving tenant by the entirety. THIS CONVEYANCE is made SUBJECT to all applicable easements, rights of way, setback lines and restrictions of record in said Register's Office. The street address of the property is believed to be 600 Clymersville Road, Rockwood, Tennessee, but said address is not part of the legal description, and if a discrepancy exists, the legal description shall control. Tax ID No. 054K - A - 018.00. THIS DESCRIPTION HAS BEEN PREPARED SOLELY FROM INFORMATION FURNISHED TO THE PREPARER, WHO MAKES NO REPRESENTATION WHATSOEVER OTHER THAN IT HAS BEEN ACCURATELY TRANSCRIBED FROM INFORMATION PROVIDED. Said Deed of Trust recites title as unencumbered, except as noted therein, but sale will be made as Trustee only, without covenants of seisin or warranties of title and will be made subject to any unpaid taxes and assessments and all valid restrictions, liens, covenants, easements, or title defects, if any, of record on said property. The sale may be free from equity of redemption, right of redemption, homestead, dower, and other rights or exemptions, if applicable pursuant to provisions in said Deed of Trust.
