A tremendous victory. That's how an attorney for plaintiffs suing TVA described a federal judge's decision to deny TVA's motion to toss out ash spill lawsuits based on governmental immunity.

“Although we expect TVA will appeal, the Court's opinion was very sound and we expect that we will be victorious there, too,” Lieff, Cabraser, Heimann & Bernstein attorney Elizabeth A. Alexander said in an e-mail.

U.S. District Court Judge Thomas A. Varlan's 80-page ruling was made public on Friday.

“The Court did rule against us on our request for a jury trial and punitive damages, and we are evaluating whether we will try to appeal those issues,” Alexander said in the e-mail. “In the meantime, we will now move forward in the litigation as quickly as possible.”
