U.S. Magistrate C. Clifford Shirley Jr. will allow Rocky Houston’s lawyer to “late file” a motion that requests the indictment in the case be dismissed.
Houston is charged with 14 counts of being a convicted felon in possession of a firearm. The deadline to file motions in the case was Feb. 27.
Defense attorney Michael P. McGovern didn’t start representing Houston until July 31. He filed the motion on Aug. 21 asking that the indictment be thrown out.
